3. User Obligations and Responsibilities

- Obtain professional advice where appropriate for legal, tax, accounting, medical, or specialized coverage matters.
You acknowledge that failure to provide accurate or updated information may result in incorrect quotations, policy rescission, denied claims, cancellation, or other adverse consequences.
4. Payment Terms and Conditions
Premiums, fees, commissions, service charges, administrative charges, and payment schedules are determined by the applicable insurer, product provider, or as otherwise disclosed to you in writing.
- All premiums must be paid on time according to the policy and billing schedule.
- Failure to make timely payment may result in cancellation, lapse, non-renewal, or interruption of coverage, subject to applicable law and insurer procedures.
- Any returned payments, chargebacks, or failed transfers may be subject to additional charges permitted by law and insurer rules.
- Unless expressly stated otherwise in writing, all fees are non-transferable and may be non-refundable, subject to applicable law and the governing policy terms.
- Where we collect or facilitate payment, you authorize us and/or the applicable insurer to process such payments in accordance with your instructions and the selected payment method.
You remain responsible for confirming payment status and ensuring sufficient funds or valid payment arrangements are in place. We are not responsible for bank delays, card declines, or other third-party payment processing issues.
5. Cancellation and Refund Policy
Cancellation and refund rights depend on the type of insurance, the insurer, the policy wording, provincial requirements, and any applicable law. You may request cancellation of a policy by contacting us or the insurer as applicable, subject to the insurer’s procedures and notice requirements.
If a policy is cancelled:
- Any refund, if available, will be calculated by the insurer in accordance with the policy terms and applicable law;
- Administrative fees, broker fees, or short-rate cancellation charges may apply where permitted;
- Coverage generally remains in force until the effective cancellation date confirmed by the insurer;
- Premium financing agreements, if any, may have separate cancellation and refund provisions.
Quotes, applications, and consulting time are generally not refundable. If a refund is available, it may be processed only after confirmation from the insurer or other relevant party. Any statutory cooling-off, rescission, or disclosure rights will apply as required by law.
6. Liability Limitations
To the fullest extent permitted by applicable law, MapleShield Insurance Agency Ltd. shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, business interruption, loss of data, reputational harm, or opportunity loss, arising from or related to your use of our services.
Without limiting the foregoing:

- We are not responsible for insurer underwriting decisions, policy wording, claim determinations, or third-party acts or omissions;
- We are not liable for losses arising from incomplete, inaccurate, untimely, or misleading information provided by you;
- We are not liable for delays or failures caused by telecommunications, internet outages, payment processors, insurers, government agencies, or force majeure events;
- Our total aggregate liability, if any, for any claim arising out of or relating to the services shall be limited to the lesser of the amount paid by you to us for the specific service giving rise to the claim or the maximum amount permitted by applicable law.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for fraud, wilful misconduct, or other non-excludable obligations under applicable Canadian law.
